Terms and conditions MATRIKS

These terms and conditions apply to all sales via the MATRIKS webshop and to orders placed via email with payment by bank transfer. You will receive these terms before placing your order and you can save them.

MATRIKS may amend these terms. For your order, the version that was applicable at the time of ordering will always apply.

1. Order

  • To place an order independently, you must be 18 years of age or older.

  • You can add products to your shopping cart and check out via our webshop. It is possible to provide a different delivery address.

  • Check your order and contact details before checking out.

  • After placing your order, you will receive a confirmation email.

  • If an ordered product is unexpectedly unavailable, we will inform you as soon as possible. You may agree to a different delivery time or an alternative. In case of cancellation, we will refund the amount for the unavailable product.

  • In the event of an obvious pricing error, which you could reasonably have recognized as an error, we will contact you. You can then order the product at the correct price or cancel the purchase. Amounts already paid for a cancelled product will be refunded.

  • Special orders can also be requested by email. Payment is then made via bank transfer. A special order is not automatically excluded from the right of withdrawal.

2. Delivery

  • MATRIKS delivers to the address you provided.

  • We aim for delivery within 4 working days, unless a different delivery period has been agreed upon with the product or your order.

  • In case of a delay, we will inform you as soon as possible. Your legal rights in the event of late delivery remain preserved.

  • We deliver to the countries available during checkout.

  • MATRIKS bears the risk of loss or transport damage until you, or a third party designated by you other than the carrier, receive the order.

3. Prices and shipping costs

  • All prices are stated in euros and include applicable VAT and exclude any shipping costs.

  • Standard shipping costs and the thresholds for free shipping vary by country and are listed in the table below.

  • For exceptionally large packages, including the Hasegawa Lucano 4-step, different shipping rates apply from € 49.95 to € 89.95, depending on the destination country. Free shipping does not apply to these items, even if the order amount reaches the stated threshold.

  • The shipping costs for your order will be displayed during checkout before you finalize the order.

  • The thresholds for free shipping are calculated on the order amount after any discounts, excluding shipping costs.

  • For deliveries to VAT-registered companies in another EU member state, an exemption from Belgian VAT for intra-community deliveries may be applied, provided that a valid foreign EU VAT number is provided and all legal conditions are met.

4. Right of withdrawal (distance selling)

  • As a consumer, you may withdraw from your distance purchase without giving any reason within 14 calendar days. The period begins on the day after receipt by you or a third party designated by you other than the carrier. If one order is delivered in separate parts, the period begins after receipt of the last part.

  • Notify us of your return within that period by email, preferably with your order number. You will receive a return label and return instructions from us. Another clear statement of your decision to withdraw is also valid.

  • After your notification, you have 14 calendar days to return the product. You do not need to wait for our confirmation to do so.

  • Pack the product carefully, preferably in the original packaging, with all parts and accessories. Opening or missing the original packaging does not exclude your right of withdrawal.

  • The direct costs of returning are for your account. When you use our return label, these costs will be deducted from your refund. For standard packages, the rates per country from the table in Article 3 apply, even if your order was delivered for free.

  • For exceptionally large packages that cannot be returned by regular mail, such as the Hasegawa Lucano 4-step, we estimate the return costs at € 49.95 up to a maximum of € 89.95 per return, depending on the country. We will communicate the exact amount with your return request.

  • You may unpack and inspect the product as you would in a store. In the event of use or handling that goes beyond what is necessary to assess the nature, characteristics, and functioning, we may deduct the demonstrable loss in value from the refund.

  • Upon withdrawal of your entire order, we will also refund the original standard shipping costs. Additional costs for a more expensive delivery method chosen by you will not be refunded.

  • We will refund you without undue delay and at the latest within 14 calendar days of your notification using the same payment method, unless you agree to another cost-free method.

  • We will process the refund after receiving your return.

  • For products made according to your specifications or clearly personalized, no right of withdrawal applies.

  • These return costs apply to withdrawal. In the event of a defect or incorrect delivery, the rules in Article 6 apply.

5. Payment

  • You can pay via Shopify Payments, bank transfer, or with a gift voucher. The available payment methods are displayed during checkout.

  • The order will be shipped as soon as the payment has been received and confirmed, taking into account the agreed delivery time.

6. Complaints and legal warranty

  • Is a product damaged, defective, or incorrectly delivered? Email us as soon as possible with your order number and, if possible, photos of the issue.

  • As a consumer, you are entitled to a two-year legal warranty on new products from the date of delivery. Report a defect within two months of discovering it.

  • In the event of a defect covered by the legal warranty, you are entitled to a free repair or replacement, in accordance with legal requirements.

  • When repair or replacement is not possible or appropriate under the law, you are entitled to a price reduction or rescission of the purchase with a refund. In the case of a minor defect, rescission is not possible.

  • If the product needs to be returned for this, you will receive instructions and a free return label from us.

  • Damage resulting exclusively from incorrect use, an accident, or normal wear and tear is not covered by the legal warranty. Your other legal rights remain preserved.

7. Website and liability

  • We take great care with the information on our website. If you notice an error, you can contact us about it.

  • We can amend or correct information on the website. This does not change your rights regarding an order already placed.

  • Damage arising exclusively from incorrect use of a product is at your expense. This does not limit our legal liability for defective products or other errors for which we are responsible.

  • Nothing in these terms limits your statutory rights as a consumer or excludes liability that cannot be excluded by law.

8. Extended producer responsibility

  • MATRIKS complies with the applicable obligations regarding extended producer responsibility for packaging.

  • For French packaging registration, MATRIKS is registered with ADEME under the unique identification number (IDU): FR542710_01DVKC.

9. Applicable law and disputes

  • These terms are governed by Belgian law. As a consumer, you also retain the protection of mandatory legal rules in the country where you usually reside, insofar as those rules apply.

  • In the event of a dispute, we will first seek a solution together. If that is not possible, the courts have jurisdiction in accordance with applicable legal rules.
